General

The following Privacy Policy governs how we handle your personal and non-personal information on SeatSmart.com, while you access and interact with the data, content, materials, information, products and services we make available to you.

Please do not access SeatSmart until you have read this Privacy Policy carefully as your access to and use of the Site is an agreement to be bound by this Privacy Policy. If you do not accept the terms of this Privacy Policy, then please do not use the Site. Additionally, use of this site is an agreement to be bound by the Terms of Use , so please also read that document.

SeatSmart contains many links to third party sites. This Privacy Policy only covers use of SeatSmart and does not apply after you have clicked through to a third party site. On third party sites, you are governed by that site's privacy policy. We do not pass third party ticket providers or any other partners your private identifying information. It is likely that they independently track what web site you were referred by.

We may make changes to this Privacy Policy at any time by posting such changes on this page. If the changes that we make to the Privacy Policy are material, we will notify you by email contact if you have provided us with your email address or by posting notice of the changes on the home page of the SeatSmart Site at least 30 days before the changes become effective. You understand and agree that if you use the SeatSmart Site after the effective date of any changes to the Privacy Policy, we will treat your use as acceptance of the Privacy Policy as changed.

For the purposes of this doucument, please refer to the following definitions of terms used herein.

Your Privacy on SeatSmart

SeatSmart helps you and your friends organize various steps of the process of attending live entertainment events including, but not limited to, finding tickets and people with whom to attend. We attempt to tailor your experience on SeatSmart to your specific needs and preferences. In order to have the best experience on SeatSmart, it is to your advantage to share information with us, other users (and potential users) of the site and in some cases, third party web sites and the services they provide. We understand you may not want some people to have the information you share on our site. As such, we give you controls to determine how and with whom your information is shared.

An "Activity Feed" is a set of actions taken on the SeatSmart site that can be published throughout the SeatSmart Network based partially on your account privacy settings. Activities such as saving ticket searches and becoming friends with other users, and others are included in this set of actions. They can be published in your activity feed, on your profile and in your friends' Activity Feed as well. These items can also be pushed out to and shared with other people on the entire SeatSmart Network. We do this to support your efforts in finding and organizing the people and tasks associated with attending live events and commemorating the experience. If you do not wish to publish this information, you can make it private by adjusting your privacy settings.

You will find privacy settings under the edit profile link after you log in and mouse over your username in the upper right hand corner of the site. Use these settings to decide whether you want your information to be open to the public, to your only your friends, or to no one. By default, your profile and feed items are set to public. If you keep your profile public, some of your actions and your profile will be viewable by anyone using the SeatSmart Network. You can limit this visibility by changing your privacy settings. Note that even if you turn your profile to private, your profile badge, which consists of your profile image and the content you enter in the "About Me" section of your profile. If you do not wish to have your true likeness show on the site, you may use another image as long as it does not appear to misrepresent you as someone else and is not the intellectual property of someone else.

You may be given the opportunity to log into SeatSmart without registering directly on our site, by using social services such as, but not limited to, Facebook Connect. When using these services, your activity feed items may be published on third party sites, such as Facebook. Please read Facebooks Privacy Policy before using the Facebook Connect product and also read the privacy policies and terms of service of any of the other third party product offerings on SeatSmart before you use them.

It is possible to search for and compare prices and locations of tickets without registering for the site and we encourage you to do that if you do not wish to share the information necessary to use the expanded functionality of SeatSmart. Otherwise, any use of the site is bound by this Privacy Policy, our Terms of Use and applicable local, state and Federal laws.

The Information We Collect From Registered Users

Registration on the site is optional. If you choose to register, we will collect your username, e-mail address, birthdate (to verifty that you are over 13) and password. Once you complete registration and log in, you will be able to fill in optional information in your profile and preferences including a bio, where you are located, your gender, what kinds of events you might want to see. You can also upload a profile picture. Other optional features for logged in and non-logged in users will provide the opportunity to publish comments, blog posts, ratings, reviews or other information (collectively "User Generated Content") that will appear on the site and/or External Network. Any information that you provide is done so at your own risk. Although we allow you to set privacy options that limit access to some of your information, be aware that no security measures are impenetrable or without fault. We cannot control the actions of other Users with whom you choose to share your information. We cannot and do not guarantee that User Generated Content you post on the Site will not be viewed by people you did not intend to share with. We are not responsible for any circumvention or disruption of privacy or security settings on the Site. By using the site, you acknowledge that you understand and accept that, even after removal, copies of User Generated Content may remain viewable in cached and archived pages or if other Users have copied or otherwise stored it independently.

What Organization is Collecting Your Information

SeatSmart, LLC, a Delaware corporation, operates and manages the SeatSmart Site, www.seatsmart.com, and is the organization that collects your information.

How We Use Your Information

Information provided in your profile and preferences is used to deliver you tailored content and information about events, tickets and other users you might be interested in as well as marketing communications if you elect to receive them. This information may be used to help your friends or other users on the network find you when there is overlap in your site-related interests or experiences.

Sharing of Your Personal Information

In general, we do not share your personal or identifying information with other parties. However, if we believe it is appropriate or necessary, or are forced to by legal mandate, we will share the information in connection with: the investigation or prevention of illegal or suspected illegal activities; the protection or defense against violations or suspected violations of the rights, property, or safety of SeatSmart, our users or other parties; the enforcement of and monitoring of compliance with our Terms of Use.

We may also share your information with third parties as it is relevant in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Sharing of Aggregate and Non-Personal Information

We may, from time to time, share statistical and anecdotal information about the SeatSmart Site and the use of it. Such information will be provided in the aggregate and without personally identifying information. It may be provided to the press, bloggers, partners, potential partners or others.

Information We Collect from Non-Registered Users

To help improve user experience and the quality of our content and search results, we collect certain non-personal information from all users of the site, whether they register or not. This information includes that which is commonly collected by many web sites including your IP address, domain name, browser type and version, time and duration of visits and page views, referring URL, platform, information on whether you are a new or repeat visitor, history of searches on the site, click activity and exit page information.

No Credit Card Environment

SeatSmart's tailored ticket search service is free and the site is a no-credit-card environment. We will never ask you for you credit card information, nor do we need it to help you find tickets. Any tickets listed on our site will be provided or sourced by a third party site. To place an order, you will need to visit that site and may be asked to provide your credit card information there. If another user asks you for your credit card information anywhere on the SeatSmart site, please do not provide it and send the link or the email from which the request was made to admin@seatsmart.com immediately. Information You Share

User-Generated Content that you provide on the site will be displayed according to your privacy settings for other users to read and interact with through the site. Further, your profile information and User-Generated Content maybe displayed or used to inform other information that is displayed on our External Network. Our use of your profile information, preferences and User-Generated Content is designed to help you and others organize and commemorate your event experience. Our Terms of Service prohibit other site users from copying or otherwise extracting your information and from republishing it. However, as with any information you publish on the Internet, there is no sure way to prevent third parties from doing so. As with any web site, you should exercise caution when deciding what you want to publish on SeatSmart. User-to-user private messages are not displayed to anyone except for the user to whom the message was sent. As with email, we cannot guarantee that user will not distribute or republish all or part of your message, so you should not send information to parties that you don't trust. If you comment on another user's profile or saved search, the content of your message may be visible to other people who have access to the profile or saved search, even if you are not friends with that user and your profile is set to "Friends Only".

When You Contact Us

If you contact us, we also will collect your IP address and email address so we can respond to you. We will use the information you provide detailing the nature of your question or problem to enhance the quality of the SeatSmart Site and Service. In the process of doing so, we may distribute the information internally and/or to contractors that are directly related to the issue or question at hand. Such contractors will be bound by confidentiality agreements to take all reasonable means necessary to protect your identity if it is provided. If you email reviews or testimonials of your experience on the site, we may ask your permisssion to publish them and if we do, the testimonial may include some or all of the following information: your name, you location, your site username, the content of your testimonial in full or abbreviated form. We will never post a testimonial from you without your express permission.

Contacting Others Through Us

During the course of your use of SeatSmart, you will be given the opportunity to contact your friends regarding the Site, ticket offers, events or other information. In some cases, you will be using native SeatSmart functionality such as comments or private messages. In other cases, you may use third party services provided by services such as Facebook or Plaxo. When using these third party services, you are bound by their privacy policies regarding the storage of your email address and personal information as well as the email address and personal information of the person you are interacting with.

Cookies

A Cookie is a small file placed on your computer's hard drive by a web server, allowing it to identify your computer. Cookies are used by many web sites to, among other things, allow you to log in to a site and have a personalized experience. SeatSmart uses cookies that do not include any personal information, but that help us track which of our Web pages are visited, which searches are performed and what services are used as well as the frequency of these actions. Although you can disable cookies at any time through any major web browser, much of the functionality of the SeatSmart Site relies on the use of cookies.

Children

Children under the age of 13 may not use the SeatSmart site under circumstances. Children under the age of 18 can only use the site with the permission of and under the supervision of their parents or legal guardians. If you believe children are using the site in violation of these terms, please contact us right away at admin@seatsmart.com.

Applicable Law for International Site Visitors

We collect, process, store, disclose and dispose of personal information that our users and submit on the Site in accordance with applicable United States law. Any personal information you submit to us will be transferred to the United States to be processed by us in the normal course of providing the SeatSmart Site and our services to you and for such other purposes as outlined in this Privacy Policy. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information, as discussed in this Privacy Policy, outside your resident jurisdiction and further, that we may store such personal information in the United States, outside of your resident jurisdiction. Please note that United States law may offer different levels of protection for personal information than may be available in your country and that the United States model relies partially on self regulation.
